Part 3. The disclosure part of the lead removal rules (see part 1 and 2 for the other guidelines) requires that an EPA booklet entitled “The Lead-Safe Certified Guide to Renovate Right” be supplied. This document must be supplied before the work is done if there is an existing tenant. The booklet must be supplied to a new renter or purchaser no later than occupancy. Make sure you get a signature on the back page of the booklet to prove you gave it to the tenant or buyer. The fine for failure to comply is reported to be $37,500 per day. So if you do the work or arrange for the work to be done on a home built prior to 1978 and you can’t prove the work was done by a Certified Renovator, you may have to reach into your wallet!
